IRS Releases Final Regulations on Comparative Effectiveness Research Fee to Fund PCORI: Guidance on Transitional Reinsurance Fee: On December 5, 2012, the Internal Revenue Service ("IRS") released final regulations regarding the payment of fees by insurers and plan sponsors of group health plans to fund the Patient-Centered Outcomes Research Institute (the "Institute" or "PCORI").

DMA Launches the ACA Pay or Play Estimator Tool: The ACA Pay or Play Estimator Tool is a strategic tool to aid in preparation of the changes that will take place in 2014 when the employer mandate from healthcare reform takes effect. The ACA Pay or Play Estimator can provide a detailed comparison of what the cost could be if a company decides to (or not to) provide benefits. It also projects the costs both to you AND your employees (looking at realistic projections) if your company elects to compensate employees for purchasing from state exchange. Safe Harbor for Determining Full-Time Employee Status Requirements Released: New guidance has been issued on two requirements under the Patient Protection and Affordable Care Act (the "Act") that will become effective in 2014. Specifically, the Treasury Department and Internal Revenue Service recently released Notice 2012-58, which describes a safe harbor approach employers may use for purposes of determining whether an employee is "full-time" for purposes of the Act's "pay-or-play" mandate.
